These Terms & Conditions govern your use of the Sejahtera website and your engagement with our family law guidance services. Please read them carefully. If any part is unclear, you are welcome to contact us before proceeding.

1 Definitions

"Agreement"
These Terms & Conditions, together with our Privacy Policy, Cookie Policy, and any engagement letter signed between us.
"We / Us / Our"
Sejahtera, a family law guidance practice operating from Level 7, Menara KEN TTDI, Jalan Burhanuddin Helmi, 60000 Kuala Lumpur.
"You / User"
Any person who visits our website or engages our services.
"Service"
The family law guidance services described on our website, including consultations, custody and maintenance guidance, and family stability engagement.
"Content"
All text, images, documents, and other material published on our website.

2 Acceptance of Terms

By visiting our website, submitting an enquiry form, or engaging our services, you indicate that you have read, understood, and agree to be bound by this Agreement.

Our website and services are intended for persons aged 18 years and above. By using this website, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement under Malaysian law.

If you do not agree with any part of this Agreement, we respectfully ask that you refrain from using our website or engaging our services.

3 Service Description

Sejahtera offers family law guidance services in Malaysia, including the following:

Family Wellbeing Consultation — RM 570

A confidential session to help families understand their options around separation, parenting arrangements, or household matters.

Custody and Maintenance Guidance — RM 1,220

Support for parents and spouses addressing hadhanah and nafkah arrangements, including documentation and representation.

Family Stability Engagement — RM 1,890

A comprehensive case management arrangement for households navigating multiple family matters simultaneously.

Services are available to individuals based in Malaysia or whose matters fall under Malaysian jurisdiction. We reserve the right to decline any engagement at our discretion.

4 User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate and complete information in all communications and forms
  • Use our website only for lawful purposes
  • Promptly respond to requests for information or documentation that we need to progress your matter
  • Treat our staff with courtesy and respect at all times
  • Not attempt to access any part of our systems that you are not authorised to access
  • Not reproduce, scrape, or redistribute any content from our website without prior written consent

Providing false information, harassing staff, or attempting to misuse our systems may result in immediate termination of any engagement and, where appropriate, reporting to relevant authorities.

5 Intellectual Property

All content on this website — including text, design, structure, logos, and service descriptions — is the intellectual property of Sejahtera or its licensors and is protected under Malaysian and international copyright law.

You are granted a limited, non-exclusive, non-transferable licence to access and view the website for personal, non-commercial purposes. This licence does not include the right to copy, distribute, modify, or create derivative works from any content.

Documents and reports prepared specifically for you as part of a service engagement remain subject to our professional obligations; any licence to use such documents will be set out in your engagement letter.

6 Payment Terms

All fees are quoted and payable in Malaysian Ringgit (MYR / RM).

Payment timing

Full payment or an agreed deposit is required before work commences, unless otherwise specified in your engagement letter.

Accepted methods

Bank transfer and other methods confirmed at the time of engagement. Receipts will be issued for all payments received.

Fees and changes

Quoted fees apply to the scope described at the time of engagement. Material changes in scope may be subject to revised fees, agreed in writing.

Cancellations

Where an engagement is cancelled before commencement, fees may be refundable less any reasonable administrative costs incurred. Once work has commenced, fees are not refundable unless otherwise agreed.

7 Service-Specific Terms

The following additional terms apply to our service engagements:

Scope of engagement

The scope of each engagement is agreed at the outset and documented in an engagement letter. Work outside the agreed scope will be addressed separately.

Confidentiality

All information you share with us in the course of an engagement is treated as strictly confidential and handled in accordance with our professional obligations and the Personal Data Protection Act 2010.

Timelines

Estimated timelines are provided in good faith. Court processes, third-party delays, and other factors outside our control may affect actual timelines. We will keep you updated throughout.

Your cooperation

Timely progress depends on your cooperation in providing accurate information and documentation. Delays caused by incomplete or late information from your side are not our responsibility.

8 Disclaimers

Important notice

9 Limitation of Liability

To the fullest extent permitted by Malaysian law, Sejahtera's aggregate liability to you in connection with any matter arising from this Agreement or our services shall not exceed the total fees paid by you to us in the 12 months preceding the relevant claim.

We shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of our website or services, including (without limitation) loss of income, opportunity, or data, even if we have been advised of the possibility of such loss.

Nothing in this Agreement limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10 Indemnification

You agree to indemnify, defend, and hold harmless Sejahtera and its staff from and against any claims, liabilities, damages, or costs (including reasonable legal fees) arising out of your breach of this Agreement, your misuse of our website, or your provision of inaccurate or misleading information to us.

11 Termination

Either party may terminate a service engagement by giving reasonable written notice. You may withdraw from an engagement at any time; fees paid for work already completed will not be refunded unless otherwise agreed.

We may terminate or suspend an engagement immediately where you are in breach of this Agreement, where continuing would create a conflict of interest or professional obligation, or where circumstances arise that make it impractical to continue.

Upon termination, Sections 5, 8, 9, 10, and 12 of this Agreement will continue to apply.

12 Dispute Resolution

This Agreement is governed by the laws of Malaysia, and any disputes arising from it shall be subject to the exclusive jurisdiction of the Malaysian courts.

Step 1 — Informal resolution

In the first instance, please contact us at [email protected] and we will make every effort to resolve the matter amicably within 21 days.

Step 2 — Mediation

If informal resolution is not achieved, both parties agree to attempt mediation before commencing legal proceedings, unless the matter is urgent.

Step 3 — Legal proceedings

Where mediation does not resolve the matter, either party may refer the dispute to the courts of Malaysia in accordance with applicable law.

13 General Provisions

Entire agreement

This Agreement constitutes the entire agreement between you and Sejahtera in relation to its subject matter, superseding any prior communications or understandings.

Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign ours in the event of a reorganisation or business transfer.

Notices

Written notices should be sent to [email protected] or to our registered address.

14 Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our services, applicable law, or business practices. The updated version will be published on this page with a revised "Last updated" date.

For material changes, we will take reasonable steps to bring these to your attention. Your continued use of our website or services following any update constitutes your acceptance of the revised terms.
